How to send comments. Comments can be mailed to the address appearing in the Public Notice or emailed to the Project Manager identified on the Public Notice. Comments made in reference to a Public Notice should include your name, address, and phone number as well as the permit application number identified on the Public Notice. 

Individuals or parties may request an extension of time in which to comment on the proposed work by writing to the project manager or clicking on the project manager’s name on the public notice grid on the web page.  Any request must be specific and substantively supportive of the requested extension, and received by this office prior to the end of the initial comment period.  The Branch Chief will review the request and the requestor will be promptly notified of the decision to grant or deny the request.  If granted, the time extension will be continuous to the initial comment period and, inclusive of the initial comment period, will not exceed a total of 30 calendar days.

LOCATION OF WORK:  In Baton Rouge, Louisiana, just south of Burbank Dr. near Bayou Fountain (30.34028, -91.10222), in East Baton Rouge Parish, within the Amite River Basin in hydrologic unit (HUC 08070202), as shown on the attached drawings.

The work described below was partially completed prior to obtaining a Department of the Army permit and was in violation of Section 301 of the Clean Water Act.  All legal issues concerning the unauthorized work have since been deferred. 

CHARACTER OF WORK The applicant has requested Department of the Army authorization to clear, grade, excavate, and deposit fill/aggregate material to construct and maintain a wetland assimilation facility (Harveston Wastewater Treatment Facility) to handle waste water treatment to serve the Harveston Residential Development to the west.  Approximately 141,000 cubic yards of earthen fill material and crushed limestone will be deposited to complete the project.  In addition a 3,800-foot long 10” diameter main distribution line along the access road will supply (3) 6” diameter distribution lines that will be installed on the ground within the 287 acre forested wetland for the treated effluent to be discharged. The proposed project is situated on an approximately 605-acre tract that has been determined to contain 571.6 acres of forested wetlands and 34.2 acres of non-wetland.  Approximately 4.42 acres of jurisdictional forested wetlands and 0.03 acre of “other waters of the US” will be permanently impacted.

The applicant claims that the project was designed to avoid and minimize direct and secondary adverse impacts to the maximum extent practicable.  Any further reduction would limit usage of the property, therefore deeming the project impracticable.  As compensation for unavoidable wetland impacts, the applicant proposes to mitigate in-kind wetland credits from a Corps approved mitigation bank located in the watershed.

The applicant may be required to fully or partially restore the site to pre-project conditions if issuance of a permit is determined to be contrary to the public interest.
