SPECIAL PUBLIC NOTICE FOR ANNOUNCING THE REVISED APPROACH TO REGULATORY DISCRETIONARY WORKLOAD

The U. S. Army Corps of Engineers (USACE), New Orleans District (MVN), by means of this notice, announces a revised approach to discretionary workload, specifically as it relates to stand-alone Jurisdictional Determinations (JD) requests for the purpose of establishing jurisdiction pursuant to Section 10 of the Rivers and Harbors Act of 1899 (RHA) (33 U.S.C. 403) and Section 404 of the Clean Water Act (CWA) (33 U.S.C. 1344), and in accordance with Regulatory Guidance Letter 16-01. As directed by the Mississippi Valley Division (MVD), districts within MVD are to prioritize non-discretionary actions that ensure timely permitting and mitigation decisions, and to de-prioritize discretionary actions such as stand-alone JDs (i.e. JDs not part of a permit application/mitigation bank proposal) to ensure proportionality across the region. As such, MVN will not be accepting new stand-alone JD requests until further notice in order to focus limited resources on non-discretionary actions. However, MVN will continue processing JD requests already received as of September 2, 2025. MVN will continually reassess resuming accepting stand-alone JD requests, in accordance with MVD’s direction and resource availability, and will publish a Special Public Notice when resumption occurs. More information about JDs including the Eng Form 6247 and the requirements for a Wetland Delineation Report is available on the New Orleans District website https://www.mvn.usace.army.mil/Missions/Regulatory/Jurisdiction-Wetlands/ and additional information about USACE Regulatory Authority and Jurisdiction is available on the RRS site at rrs.usace.army.mil.
