Section 106 of the National Historic Preservation Act

Section 106 of the National Historic Preservation Act of 1966, as amended (NHPA), requires Federal agencies to take into account the effects of their undertakings on Historic Properties and afford the Advisory Council on Historic Preservation (ACHP) a reasonable opportunity to comment on such undertakings. Historic Properties may include prehistoric or historic districts, sites, buildings, structures, objects, sacred sites, and traditional cultural places, that are included in, or eligible for inclusion in, the National Register of Historic Places (NRHP). Therefore, prior to the issuance or authorization of any permit under Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act, the U.S. Army Corps of Engineers, New Orleans District Regulatory Division must consider the effect the permit may have on Historic Properties.
 

Cultural Resources Submissions

In order to assist us in ensuring compliance with Section 106 of the NHPA, the New Orleans District Regulatory Division is working to establish Guidelines for Compliance with Section 106 of the NHPA. Guidelines will provide information needed to initiate consultation with the State Historic Preservation Officer (SHPO) and/or Tribal Historic Preservation Officer (THPO). For now, when you submit information, we recommend reviewing the Guidance set forth by South Pacific Division, Sacramento District. Please follow standard procedures for preparing documents per Louisiana SHPO guidelines.

Submitting cultural resources reports and GIS files (i.e., SHP, KMZ) of the proposed project and conducting Phase I identification surveys early in the process is a major benefit to the applicant and saves time upfront. If your file(s) are over 20 mb, please contact POC and request a Department of Defense Safe Link for file sharing. For Pre-Application Coordination/Consultation, please contact POC. 

Inadvertent Discovery

In the event that Historic artifacts or remains are discovered, immediately cease work and please call the POC. In the event that Native American/Precontact artifacts or remains are discovered, immediately cease work and please call the POC.
