How to send comments. Comments can be mailed to the address appearing in the Public Notice or emailed to the Project Manager identified on the Public Notice. Comments made in reference to a Public Notice should include your name, address, and phone number as well as the permit application number identified on the Public Notice. 

Individuals or parties may request an extension of time in which to comment on the proposed work by writing to the project manager or clicking on the project manager’s name on the public notice grid on the web page.  Any request must be specific and substantively supportive of the requested extension, and received by this office prior to the end of the initial comment period.  The Branch Chief will review the request and the requestor will be promptly notified of the decision to grant or deny the request.  If granted, the time extension will be continuous to the initial comment period and, inclusive of the initial comment period, will not exceed a total of 30 calendar days.

LOCATION OF WORK: The project would affect waters of the United States and navigable waters of the United States associated with Atchafalaya River. The project/review area is located on the East side of Louisiana Highway 3177, at Latitude North: 30.3245083°N, Longitude West: -91.6886027°W in the community of Butte La Rose, in St. Martin Parish, Louisiana.

The work described below was partially completed prior to obtaining a Department of the Army permit and was in violation of Section 301 of the Clean Water Act. All legal issues concerning the unauthorized work have since been deferred.

EXISTING CONDITIONS: The 27.33-acre site is situated between the Atchafalaya River and the West Atchafalaya Basin Protection Levee, off of Louisiana Highway 3177. The site contains two non-jurisdictional wetland areas, non-wetland waters, non-wetlands, and Section 10/404 jurisdictional wetlands. There is an existing access road and pad, which was previously authorized under MVN-2005-00611-WB. A tolling agreement was issued due to unauthorized clearing operations in Section 10/404 jurisdictional wetlands.

PROJECT PURPOSE:

Basic: Commercial

Overall: Sand mining operations for an existing facility.

DESCRIPTION OF WORK: The applicant requests authorization to conduct clearing operations within an approximately 294-foot wide by 774-foot long area for equipment storage, chipping operations within a 40-foot wide by 766-foot long area, sand mining operations within an approximately 94-foot wide by 766-foot long area along the Atchafalaya River, and placing approximately 4,444 cubic yards of dredged sand fill material within a 90-foot wide by 170-foot long by 9-feet high stockpile area, all for an existing sand mining facility. The stockpile area would be located in a non-wetland location. Approximately 5.49 acres of jurisdictional forested wetlands would be permanently impacted and approximately 1.82 acres of jurisdictional forested wetlands and 1.01 acres of non-wetland waters would be temporarily impacted via project implementation.
